PLEASE HELP! What amount to pay to get my Kocan?
I have an opportunity to get my Kocan (6 years later) and having given up all hope. My solicitor tells me that if I will pay all the builders dues and the KDV then he might be able to swing it . The builder went bust but my landowner is a lovely, honest man who did not sign over the Deeds to the builder - he just has no money to pay everything which may be due.
I think that there is a tax of 3% and I am sure that there is some KDV also but just have no idea what the rate is.
My contract price is 65k - can anyone tell me what is due please?
It would be a dream finally come true to get the Kocan and have some peace of mind at last!

All I can tell you is that when I bought my house last year for £30,000 my lawyer said expect to pay £2000 in total to get the kocan. The rate then was 6% which has since been reduced to 3% Hope this helps.

Be prepared to be hit with the builders stoppage tax.

Ensure the house with boundaries is actually incorporated on the kocan

I estimate about £10k based on what we had to pay ( + a bribe in our case)

Have a little bit more information: Went to the tax office in Girne this morning. They said I would have to pay the stoppaj tax (capital gains tax I think) They say this is 4%.
They gave me 4 copies of a yellow form to fill out and take to the Tapu for verification. I must then take it back to them and they will work out the total of everything which must be paid.
As advised I asked them to find out whether the builder has a KDV Credit - this, if it exists would reduce my KDV.
I also know that there is a 3% to pay.
Anyway, I am a little nearer to discovering what is to pay and will post on here when I have the facts.

If the builder has gone bust just who is transferring the title to you? Who is demanding the KDV? The builder? His bank? The land owner?
You need to check that there is an individual kocan just for your property and that all the buildings are recorded on it.
The stopaj is the liability of the transferor of the title. If you are being forced into paying it you might try deducting the amount of stopaj (4%) from any KDV (5%). Your "nice" landowner is likely to have a bulging bank balance.
Has your lawyer given you proper advice? What has (s)he said?
NB KDV and stopaj are not always payable although it is most likely they are in your case. Has your lawyer checked this?

My friend has just received her PTP.Although she paid for the house, for personal reasons, the kocan is in her partner's name but they now want her name added to the kocan.
Anyone any ideas of how much this will all cost?
